Man gets 2 years for sex with teen
LISBON — A Lisbon man was sentenced to two years in prison for two counts of unlawful sexual conduct with a minor after having sexual activities with a 13-year-old girl half his age.
Dakota Shaine McCluskey, 28, Hill Top Road, Lisbon, had pleaded guilty a week ago to the charges, which involved an inappropriate sexual relationship on at least two occasions with the girl starting around June 1, 2018 and continuing through Sept. 30, 2018.
Assistant County Prosecutor Tammie Riley Jones said McCluskey was friends with the teenage girl’s father and became familiar with the girl while spending time with the father. Although the girl’s legal guardians were contacted about Friday’s hearing, Jones said they chose not to appear.
Jones asked for a two-year prison sentence to be served consecutive to time McCluskey is currently serving in drug-related cases.
Defense attorney Jennifer Gorby suggested that McCluskey is a very young man and mentally he relates to younger people. Instead of consecutive time, Gorby asked Judge Scott Washam to consider running the time concurrently, noting that he picked up all his drug charges and these charges around the same time.
Common Pleas Court Judge Scott Washam sentenced McCluskey to the additional two-year prison term. He will also be considered a Tier II sexual offender required to register his address every six months for 25 years.
“Mr. McCluskey, when you are 25 years old and you having sexual relations with a child 13 or 14 years old, obviously that is something that is simply not tolerated,” Washam said.
