COLUMBIANA COUNTY MUNICIPAL

LISBON — In Columbiana County Municipal Court, a preliminary/pretrial hearing was set Jan. 12 for Kazon Carter, 23, Commerce Street, Wellsville, charged with disruption of public services, a fourth-degree felony, and misdemeanors for aggravated menacing, assault and obstructing official business.

On July 24 in Wellsville, Carter allegedly slapped a woman in the face after an argument and threatened her. While she was on the phone with 911, he allegedly grabbed her phone and disconnected the call. On Aug. 16 in Wellsville, Carter allegedly started to run to avoid being taken into custody after police stopped him regarding a warrant, with police giving multiple commands for him to stop before tasing him.

A preliminary/pretrial hearing was set Jan. 30 for Galphin Chavous, 30, Lincolton, Ga., charged with improper handling of firearms in a motor vehicle, a fifth-degree felony, and misdemeanors of operating a vehicle under the influence of alcohol or drugs first offense, traffic control devices, license plate light and left of center. Chavous allegedly possessed a loaded pistol under the driver’s seat of his vehicle during a traffic stop Dec. 31 in Lisbon.

A pretrial was set Jan. 12 for Krystal Ulizio, 35, Granite Street, Salem, charged with domestic violence for allegedly pushing a man and hitting him while he was trying to leave the Granite Street, Salem residence on Dec. 30. Bond was set at $5,000 cash or surety and she was ordered to have no contact with the victim.

Howard Beniston, 51, Girard, was fined $700 and sentenced to 180 days in jail, with 179 days suspended and credit for one day served, for engaging in prostitution and possessing criminal tools. He was permitted to buy out 60 hours community service and $240 seized was ordered forfeited to the Mahoning Valley Human Trafficking Task Force. Beniston solicited sexual conduct in exchange for $240 from an agent posing online as a woman and arriving Nov. 1 in East Palestine for the meeting.

A pretrial was set March 20 for Russell Miller, 41, Struthers, charged with engaging in prostitution, possessing criminal tools and voyeurism for allegedly arranging for sexual activity in exchange for money with an agent posing as an adult mother and daughter and arriving in East Palestine on Jan. 1 for the meeting. During the investigation, it was discovered that Miller allegedly possessed at least three videos secretly recorded of an adult female he knows in a state of nudity using the restroom.

A pretrial was set March 21 for Heath Long, 35, Moundsville, W.Va., charged with theft for allegedly grabbing several items from inside the Calcutta Walmart and returning them to receive cash after not paying for them and also grabbing two more items and leaving the store without paying for them on Dec. 30.

Sabrina Betz, 25, South 14th Street, Sebring, was fined $250 and sentenced to 180 days in jail, with 177 days suspended, leaving three days to serve for theft for failing to scan and pay for $154 worth of items at the Salem Walmart on Dec. 16. She was also ordered to complete 40 hours community service.

A pretrial was set Jan. 12 for Carter Hollinger, 20, Enon Valley, Pa., charged with disorderly conduct for an alleged incident Oct. 5 in St. Clair Township when he was flipping off vehicles, claiming someone was following him and yelling and making gestures toward police cruisers.

A pretrial was set March 20 for Bailey Riddle, 21, Firestone Avenue, Columbiana, charged with disorderly conduct for allegedly throwing things around the front yard on Jan. 2 and then later urinating in the front yard the same day on Firestone Avenue, Columbiana.

Aleia Hawk, 21, Main Street, Wellsville, was fined $350 and sentenced to 90 days in jail, with 75 days suspended and two days credit, leaving 13 days to serve for disorderly conduct and criminal damaging. She was ordered to complete 50 hours community service. Hawk broke a desk lamp and windows inside a Broadway Avenue residence in Wellsville on Sept. 27.

A pretrial was set Jan. 12 for Steven Spargo, 27, Granite Street, Salem, charged with domestic violence for allegedly injuring a woman during a domestic on Dec. 30 at the Granite Street, Salem residence after pushing her down, hitting her and attempting to choke her.

Elijah Hundley, 30, South 14th Street, Sebring, was fined $250 for theft and ordered to complete 40 hours community service for failing to scan and pay for $154 worth of items at Salem Walmart on Dec. 16.

A pretrial was set Jan. 12 for Shirley DiCioccio, 56, East Sixth Street, Salem, charged with domestic violence for allegedly striking a man multiple times and throwing items at him on Jan. 1 at an East Sixth Street, Salem residence.

A pretrial was set March 27 for Joseph Marriotti, 32, Youngstown, charged with possessing criminal tools, obstructing official business, soliciting and open container for allegedly soliciting sexual activity in exchange for $70 from an undercover agent posing as two females online and arriving in East Palestine on Dec. 30 for the meeting.

A pretrial was set Jan. 12 for Joseph Jolly, 36, Benwood, W.Va., charged with domestic violence for allegedly causing harm to a woman on Dec. 31in Liverpool Township, punching her in the face, pushing her on the couch and choking her until she was unconscious.

A pretrial was set March 20 for Dustin Brooks, 35, Vine Street, East Liverpool, charged with criminal damaging for allegedly using a large rock to strike the front fender of a police cruiser parked in front of the East Liverpool Police Department. He allegedly said he struck the cruiser because his neighbors were harassing him.

A pretrial was set Jan. 12 for Nicole Carr, 25, Dresden Avenue, East Liverpool, charged with domestic violence for allegedly punching a man in the face after a verbal altercation in Liverpool Township on Jan. 1.

Samantha Adams, 39, Hammondsville, was fined $250 and sentenced to three days in jail for theft for stealing a tire from Three Brothers Auto on July 30 in St. Clair Township.

A pretrial was set March 27 for Brock Joy, 33, Sunset Drive, Lisbon, charged with aggravated menacing and disorderly conduct for allegedly being involved in an altercation on McCormick Run Road, Wellsville on Oct. 10 and threatening the victim.

A pretrial was set March 20 for Jazmine Caldwell, 24, Sharpsville, Pa., charged with OVI first offense, OVI breath first offense, no turn signal, driving on left side, traffic control device, possessing marijuana, drug paraphernalia and open container. During a traffic stop Dec. 31 in East Palestine, Caldwell allegedly possessed a glass bowl with burnt marijuana, marijuana and an open container of fireball whiskey.

David Brittain, 59, East North Avenue, East Palestine, was fined $425 and sentenced to 90 day in jail, with 87 days suspended, leaving three days to serve for OVI and left of center. His driver’s license was suspended for one year and he was ordered to complete 40 hours community service.

A pretrial was set March 20 for Gary White Jr., 31, Mound Street, Salem, charged with OVI first offense, no motorcycle endorsement and reasonable control.

A pretrial was set March 23 for Nicole Cregger, 24, Hubbard, charged with OVI first offense, OVI breath first offense and speeding.

A pretrial was set March 16 for Jacob Willison, 41, Malibu Road NE, Minerva, charged with OVI second offense, OVI breath second offense, driving under suspension and failure to control.

A pretrial was set March 27 for Lisa Mountz, 62, Rose Drive, Lisbon, charged with obstructed view and possession of drugs for allegedly possessing a prescription bottle containing a suspected schedule four drug with the prescription label torn off during a Jan. 2 traffic stop in Lisbon.

Christopher Chadwick, 47, Jefferson Street, East Liverpool, was fined $150 for driving under suspension.

Catherine Gregg, 25, Lorain, was fined $290 for driving under suspension, possessing marijuana and traffic control devices. Another charge of driving under suspension was dismissed.

A pretrial was set March 21 for Juan Diego Ortiz Guerrero, 28, Biloxi, Miss., charged with OVI first offense and no valid license.

Charles J. Smith, 42, Dewey Avenue, East Liverpool, was fined $180 for driving under suspension and a stop sign violation.

A pretrial was set March 13 for Gerrett Collier, 32, Youngstown, charged with driving under suspension.

A pretrial was set March 20 for Kaden Davis, 24, Carbon Hill Road, East Palestine, charged with driving under suspension.

A pretrial was set March 20 for John Harmocy, 40, Mineral Ridge, charged with driving under suspension and speeding.

COLUMBIANA COUNTY GRAND JURY

LISBON — Two drug defendants served recently with secret indictments issued by the Columbiana County Grand Jury included:

— Timothy Thrasher, 26, Lincoln Avenue, Wellsville, aggravated possession of drugs, a fifth-degree felony, for allegedly possessing hydrocodone on May 4, 2022.

— Shaun DeLauder, 42, Clark Avenue, Lisbon, aggravated possession of drugs, a fifth-degree felony, for allegedly possessing methamphetamine on Feb. 16, 2022.

COLUMBIANA COUNTY COURT NEWS

LISBON — A petition for post-conviction relief sought by convicted sex offender Charles Fuller Sr. was denied.

Columbiana County Common Pleas Court Judge Scott Washam ruled the petition was untimely, considering Fuller never appealed his case and filed the request for post-conviction relief 365 days after the deadline to file an appeal.

Fuller, 55, whose address was listed as Marion Correctional, pleaded guilty on Aug. 23, 2021 to gross sexual imposition, a third-degree felony, and was immediately sentenced to four years in prison. He received credit for 462 days already served in jail.

Washam noted in the court entry that Fuller was represented by counsel and raised some of the same issues he was claiming for the relief during proceedings before the trial court, with those issues decided at that time.

The indictment against Fuller accused him of having sexual contact with a child less than 13 years old in November 2015.

Also in Common Pleas Court:

— Journey Mykal Wayts, 30, New Middletown, was denied a recent motion for work release. Wayts was placed under community control on probation for three years and ordered to serve 90 days in the county jail for attempted compelling prostitution, a fourth-degree felony. A charge of possession of criminal tools was dismissed as part of the plea agreement reached earlier this fall. Wayts had originally been charged for compelling prostitution for arranging to meet in East Palestine on Aug. 16, 2021 with an undercover officer he believed to be a 16-year-old prostitute, agreeing to pay $80 in exchange for sexual conduct.
