Grand Jury

LISBON — John Powell Jr., 34, Florence Street, East Liverpool, was served Thursday with a secret indictment issued by the Columbiana County Grand Jury for fifth-degree felony aggravated possession of drugs and misdemeanor possessing drug abuse instruments for allegedly possessing methamphetamine and a syringe on Aug. 15, 2023.

Municipal

LISBON — In Columbiana County Municipal Court, a sentencing hearing was set Sept. 26 for Zachary Englant, 34, Canton, who entered a guilty plea to violating a protection order and telecommunications harassment, both misdemeanors, for sending multiple messages on social media on Sept. 3 to a woman who has a protection order against him and also sending unwanted harassing text messages, phone calls and cash app notes with messages attached in November 2023.

A pretrial was set Nov. 21 for Brian Curran, 36, Globe Street, East Liverpool, charged with domestic violence for allegedly making a swinging motion to a woman who ended up on the ground on Sept. 12 in East Liverpool.

A pretrial was set Nov. 19 for Jasmine Powers, 24, Rose Drive, Lisbon, charged with falsification for allegedly making a false statement to a Lisbon police officer on May 23, claiming she was given baked goods with THC without her knowledge, keeping up the statement on two other occasions. Lab results showed the baked goods tested negative for THC.

A pretrial was set Sept. 26 for Tyler Corbisello, 30, 10th Street Extension, Wellsville, charged with violation of a protection order for allegedly sending multiple text messages to a woman and making several attempts to call her in violation of a protection order on Aug. 15 in Salineville.

A pretrial was set Dec. 12 for Kazon Carter, 24, Youngstown, charged with drug paraphernalia for allegedly possessing digital scales with white residue in the rear center console near where he was seated in the rear seat of a vehicle during a traffic stop on Sept. 7 in St. Clair Township.

A pretrial was set Sept. 26 for Tiffany Potts, 36, West Third Street, Salem, charged with operating a vehicle impaired second offense, no valid license and reasonable control.

A pretrial was set Dec. 17 for Scott Gaskill, 56, Lisbon Street, East Liverpool, charged with OVI first offense and OVI breath first offense.

A pretrial was set Nov. 26 for Gregory Cresap, 63, Steubenville, charged with OVI first offense, OVI breath first offense and reasonable control.

A pretrial was set Dec. 16 for Matt Juillerat, 33, East Washington Street, Lisbon, charged with driving under suspension.

Court News

LISBON — A Warren man charged with multiple drug counts was sentenced to at least five years in prison with consecutive sentences for three charges after entering a guilty plea in Columbiana County Common Pleas Court.

John Wagner, 38, was sentenced to two years for aggravated possession of drugs, a second-degree felony, an additional 24 months for third-degree felony tampering with evidence and an additional 12 months for fourth-degree felony possession of heroin. He was sentenced to 180 days in jail for misdemeanor endangering children, but the term was ordered served at the same time as the other terms.

Charges of first-degree felony aggravated trafficking in drugs, fourth-degree felony possession of fentanyl-related compound, fifth-degree felonies of possession of cocaine and two counts possession of fentanyl-related compound, all with specifications for forfeiture of money from a drug case, third-degree felony aggravated possession of drugs and one misdemeanor count of endangering children were all dismissed.

Wagner was also fined $10,000 and received credit for 19 days served in jail.

On Dec. 27, 2022, he tampered with evidence and on Dec. 29, 2022, he possessed an amount of methamphetamine equal or greater than five times bulk, but less than 50 times bulk, and heroin equal or greater than 1 gram, but less than 5 grams. He also allegedly put a child at risk on Dec. 29, 2022.

This sentence was ordered served concurrent or at the same time as an 18-month prison term he received last month in another drug case for third-degree felony aggravated possession of drugs and fifth-degree felony possession of fentanyl-related compound, along with fifth-degree felony failure to fulfill violent offender database duties. In those cases, Wagner possessed methamphetamine in an amount equal or greater than bulk but less than five times bulk and possessed fentanyl on Nov. 8, 2022. The indictment for the other charge stemmed from Wagner being a violent offender required to register his address with the sheriff’s office, which he failed to do on Feb. 21, 2023.

Also in Common Pleas Court:

— Aaron Porter, 38, New Cumberland, W.Va., was placed on an intervention plan for 24 months after pleading guilty to three counts of fifth-degree felony aggravated possession of drugs and a misdemeanor of possession of drugs for possessing methamphetamine, buprenorphine, amphetamine and LSD on June 15, 2023.

— Nathen Wiseman, 34, West Main Street, New Waterford, was sentenced to 36 months in prison for third-degree felony failure to provide notice of change of address, to be served consecutive to the 24-month sentence he already received last month for failure to verify address. That brings his total prison time to 60 months, or five years for failing to verify his address on Dec. 20, 2023 and on July 11, 2024 as required as a registered sex offender. He received credit for 136 days already served.

— Jerry Lee Womack, 40, Austintown, was sentenced to 12 months in prison for third-degree felony aggravated possession of drugs, specification for forfeiture of money in a drug case and misdemeanors of engaging in prostitution, possessing criminal tools and illegal use or possession of drug paraphernalia. He was also fined $5,000 and ordered to forfeit $394. On June 17, 2023 in East Palestine, he possessed 12.97 grams of methamphetamine after arriving for a meeting he had arranged for sex acts with a female in exchange for methamphetamine. He had responded to an undercover ad posted on a known prostitution website. The female was actually a police officer posing as a female online. He also possessed $394.

— Donald McGee, 26, Youngstown, was placed on a treatment plan for three years after pleading guilty to fifth-degree felony theft for taking a Dell laptop from Pennex Aluminum in Leetonia on Dec. 13, 2023.

— Michael Earich, 51, Campground Road, Wellsville, was placed under community control for three years and ordered to complete the program at the Eastern Ohio Correction Center for possession of cocaine, a fifth-degree felony for possessing cocaine on May 27, 2022.

— Andrew Brown, 40, Elmwood Drive, Lisbon, was placed under community control for three years and ordered to complete the program at the Eastern Ohio Correction Center in Wintersville for fifth-degree felonies of theft, illegal use of supplemental nutrition assistance program benefits or WIC benefits and three counts of nonsupport of dependents and misdemeanors of falsification, theft and drug paraphernalia. In one case, he received credit for two days served in jail, with credit for 94 days served in the other case. Brown was accused of stealing a cage-enclosed trailer on Sept. 8, 2023 in Salem and giving police a false name when approached, besides possessing paraphernalia. The illegal use of benefits and theft were part of a prosecutor’s information that accused of misusing and stealing $217.76 worth of SNAP benefits. He was also accused of failing to pay child support for three children from Dec. 26, 2021 to Dec. 14, 2023.

— Lance Morris, 38, Hilltop Drive, Lisbon, was sentenced to nine months in prison, with credit for two days served in jail, for two counts possession of cocaine, a fifth-degree felony, along with one specification for forfeiture of money from a drug case. He was ordered to forfeit $805. Morris possessed cocaine and $805 on March 16, 2021 and possessed cocaine on April 6, 2023.

— Traci Wells, 46, East Seventh Street, Salem, was placed under community control for two years after pleading guilty to two counts of aggravated possession of drugs, a fifth-degree felony, for possessing methamphetamine on May 29, 2022 and on May 22, 2023.

— Michael Souers, 37, Cleveland Street, Salem, was sentenced to eight months in prison for possession of fentanyl-related compound, a fifth-degree felony, with credit for 43 days served in jail. Souers possessed fentanyl on Sept. 24, 2022.

— Gabriella Hosey, 26, Youngstown, was placed on an intervention plan for 18 months after pleading guilty to aggravated possession of drugs and possession of cocaine, both fifth-degree felonies, for possessing methamphetamine and cocaine on Sept. 30, 2023.

— Justin Davis, 39, West Pine Lake Road, Salem, was placed under community control for two years after pleading guilty to a lesser-included offense of aggravated trespass, a misdemeanor. He was originally charged with a felony with a firearm specification for kicking in the door to a Rose Drive, Lisbon residence on Jan. 5 and after being pushed out, pulling out a firearm and discharging it.

— Fred Bryan, 45, Chester, W.Va., was ordered to serve 90 days in jail, with credit for 23 days served, leaving a balance of 67 days to serve in the county jail for violating his probation for possession of fentanyl-related compound, a fifth-degree felony. His probation was dishonorably terminated. Bryan possessed fentanyl on March 27, 2023.

— Benjamin Cronin, 45, Wood Street, Salineville, was ordered to serve 50 days in the county jail for violating his probation for aggravated possession of drugs, a fifth-degree felony, for possessing hydrocodone on March 29, 2019. His probation was dishonorably terminated.
