Secret indictment served for vehicular homicide to Niles man for two-vehicle crash last fall

LISBON — A secret indictment for aggravated vehicular homicide was served Thursday to a Niles man accused of causing the death of a Tennessee woman in a two-vehicle crash on state Route 172 in West Township last fall.

Michael James Scheuring, 39, was indicted last week for the third-degree felony charge, with the indictment alleging that on Oct. 11, 2025, while operating a 2025 International, he caused the death of Diane Lewallen, recklessly.

Diane Lyn Lewallen was 44 years old at the time of her death and lived in Monroe, Tenn. According to her obituary, survivors included her husband, Eric, two children and two stepchildren.

According to the Ohio State Highway Patrol report, a tanker truck driven by Scheuring was traveling east on state Route 172 at 7:46 p.m. Oct. 11, 2025 when he allegedly drove off the roadway to the right, overcorrected, crossed the center line, overturned and struck a westbound Ford Bronco driven by Lewallen and ran off the roadway to the left. The Lewallen vehicle ran off the roadway to the right and overturned.

Both Lewallen and her front seat passenger, who was her daughter and 17 at the time, were wearing seat belts. Both front and side airbags deployed for both Lewallen and her passenger. Lewallen had to be extricated, but died. The passenger wasn’t trapped and was taken by Hanover Township EMS to Mercy Hospital in Canton for treatment of her injuries.

Scheuring was also injured and taken to Mercy Hospital in Canton by Minerva EMS. He was wearing a seat belt. No alcohol or drug tests were given.

According to a news report by WKBN, the location of the crash was near Zepernick Lake.

Also served with secret indictments were:

— Tracy E. Johnson III, 40, Columbus, two counts each of theft, passing bad checks, forgery and criminal simulation, all fifth-degree felonies, for allegedly stealing money from May 30, 2023 to June 2, 2023 from William Lowry and Lowry Tool & Dye, forging a check for $1,986.98 payable to himself on May 30, 2023 and then also forging another check to himself for $1,996.98 on May 31, 2023.

— Steve E. Cunningham, 35, Erie Street, East Liverpool, aggravated possession of drugs, a fifth-degree felony for allegedly possessing methamphetamine on July 3, 2024.
