Former EL officer files demand for jury trial

EAST LIVERPOOL -- Former East Liverpool Police Officer Chris Green has filed a demand for jury trial for his Civil Rights violation lawsuit in which he alleges his First and 14th Amendment Rights were violated. According to court records the demand for jury was filed Nov. 20.

Green filed the lawsuit against the City of East Liverpool; Greg Bricker, mayor; David Dawson, safety/service director; Fred Flati, police captain; Darin Morgan, police captain and Chad Tatgenhorst, police captain, in both their official and personal capacities on March 6 in the United States District Court for the Northern District of Ohio Eastern Division.

According to court records, Green is seeking a declaration that the named defendants' acts and conduct constitute violations of state and federal laws and the United States Constitution, the defendants be prohibited from alleged further retaliation, a judgment in his favor on all claims of relief, full compensatory damages, both economic and non-economic, including damages for back pay, front pay, pain and suffering, mental anguish, emotional distress humiliation, and inconveniences that he alleges to have suffered and expects to suffer in the future. He is also seeking punitive damages for all alleged intentional and malicious violations of federal and state law and constitutional rights, and that he be awarded the prejudgment and post-judgement interest at the highest lawful rate. He further requests that he be awarded reasonable attorney fees, expert fees and all other costs/expenses of the lawsuit and that he be awarded all other relief in law or equity that he may be entitled to and that the court finds equitable and just.

Green, who was terminated from the East Liverpool City Police Department on June 24, 2021, alleges in his suit that he was wrongfully terminated and that his termination was a retaliatory act in response to him reporting alleged misconduct of other officers to the Federal Bureau of Investigation which he believes violated his First Amendment Right of constitutionally protected free speech.
