LISBON — Columbiana County Common Pleas Court Judge Scott Washam recently denied a motion to suppress filed in the case against a Salem man who challenged his arrest for impaired driving.

Brent Miller, 39, Salem Alliance Road, was indicted earlier this year for two counts of third-degree felony operating a vehicle under the influence of alcohol, a drug of abuse or combination of both and a misdemeanor driving under suspension for allegedly driving impaired on April 8 and being previously convicted of felony OVI in 2019.

A jury trial remains set for Sept. 9.

Washam ruled that the Salem police officer who charged Miller had probable cause for the OVI arrest. The defense claimed a statement by Miller was in violation of his Miranda rights, but Washam noted the statement made by Miller was voluntarily made.

Also in Common Pleas Court:

— David Adams, 46, Garner Avenue, East Liverpool, was sentenced to 12 months in prison for third-degree felony having weapons while under disability and fifth-degree felony aggravated possession of drugs. He received credit for 132 days served for the drug charge. Adams was accused of possessing methamphetamine on Feb. 7, 2022 and of having a weapon on April 19 this year. He’s prohibited from having a weapon due to a previous felony drug conviction.

— Larry Blakeley, 34, Follansbee, W.Va., was placed on probation for two years, with a 90-day term in the county jail suspended and a $10,000 fine suspended for open burning or open dumping of solid waste, an unclassified felony. He was ordered to make $500 restitution. Blakeley was accused of recklessly disposing of solid waste by open dumping in Columbiana County on March 28, 2021.
