LISBON - The owner of a Columbiana jewelry store has been given two choices by Columbiana County Common Pleas Court Judge Scott Washam.
William R. Kimpel, the owner of Kimpel's Jewelry, either must return to a Cleveland area man a ring without its diamond and pay more than $5,000, or pay the man nearly $15,000.
Washam issued the written order this week in a civil lawsuit brought by Samuel G. Donadio of Brooklyn, Ohio.
In the suit, Donadio claimed he gave Kimpel the diamond ring on consignment. Donadio claimed Kimpel sold the ring, but never gave him any compensation.
Washam ordered Kimpel to return to Donadio the ladies engagement ring minus the center cut diamond before April 21. Additionally, he was ordered to pay $5,300 to the plaintiff at the time of the delivery of the ring.
Donadio is permitted to make arrangements to have the ring delivered and inspected.
However, if Kimpel should fail to comply with those orders by April 21, he instead has been ordered to pay Donadio $14,956 for the value of the ring.
Donadio had been seeking in excess of $15,000 when the case was filed in late October.
