Jury decides in defendant’s favor

LISBON - Following more than two days of testimony last week in Columbiana County Common Pleas Court, a jury found in favor of the defendant, the driver of one of the vehicles involved in an accident.

During a civil trial in Judge C. Ashley Pike's courtroom, a jury of eight people determined Tina Cienik was not negligent in the injuries of Patrick Prokop during a traffic crash on Feb. 18, 2010.

Prokop had alleged Cienik suddenly and negligently failed to yield the right of way, causing a high speed crash with Prokop's vehicle on state Route 154 in Negley. Prokop had been seeking $25,000 for damages.

The jury determined Cienik was not negligent in causing a direct injury to Prokop. At one point during about two hours of deliberation, the jury had questioned whether or not Prokop had his headlights on at the time of the accident.
