BOE, superintendent appeal court ruling

LISBON - Superintendent James Herring and the East Liverpool Board of Education have appealed a recent decision by East Liverpool Municipal Court Judge Melissa Byers-Emmerling ordering them to pay $170 plus costs after a Bow Wow concert was canceled.

According to court documents, Byers-Emmerling ruled the school employees presold tickets for two months before the event, before canceling the concert and before requiring liability insurance for the concert to be filed. She noted the school should not have sold the tickets until the liability insurance was in place.

Although the school had contended it was not involved in the joint venture with the promoter, Terrance Smitherman, Byers-Emmerling disagreed, noting school employees were promoting the event and selling tickets on school property.

Court documents show filing fees for the appeal to this point have been $94. The appeal will be sent to the Seventh District Court Appeals.
