Common Pleas for 12-20

An East Liverpool man accused of burning tires pleaded guilty recently to a criminal offense of prohibitions for open burning.

Earnest Bruce Hayes Jr., 56, of 824 Fifth Ave., entered the plea to prosecutor's information in Columbiana County Common Pleas Court before Judge C. Ashley Pike.

Sentencing has been set for Feb. 26. Court documents said Hayes burned the scrap tires on Dec. 14, 2008.

Also in Common Pleas Court:

Phillip Whinnery, 23, of 999 Prospect St., Salem, was sentenced to eight months in prison for two counts of receiving stolen property, a fourth-degree felony, for possessing two shotguns stolen from a vehicle in Salem on Dec. 17, 2008. He was originally charged with three counts of theft and received credit for 106 days already served in the county jail.

Thomas Pittenger, 42, of 779 Ohio Ave., East Liverpool, pleaded guilty to two counts of non-support of dependents, a fifth-degree felony, with sentencing April 23. Documents said Pittenger failed to pay child support for two children from Jan. 1, 2007 to April 1 this year.

James E. Ray, 34, of Chester, W.Va., was sentenced to six months in prison for non-support of dependents after he was found in violation of his probation. He received credit for 29 days already served in the county jail. Documents said he failed to pay child support from February 2002 to January 2008.

A charge of breaking and entering against James Moore, 20, of 933 Cedar Alley, Wellsville, was dismissed by the prosecution, with costs taxed to the state.
