Columbiana County Juvenile Court for 11-21

POSTED: November 21, 2009

An 8-year-old student at McKinley Elementary School in Lisbon has been charged in Columbiana County Juvenile Court for allegedly striking his school principal Helen Otto on the arm on Oct. 26.

Lisbon Police filed the assault charge, which would be a fifth-degree felony if committed by an adult, on Nov. 6.

County assistant Prosecutor Denise Weingart said the child had been having issues with going to school and began hitting at the principal and hit her on the forearm. Normally, an assault charge like that would be a misdemeanor, but because the victim was an administrator and the incident occurred on school property, the charge is elevated to felony status, which is a more serious charge.

No date has been set for the child's initial appearance in court.

Charges of domestic violence have been filed against two other juveniles, with both charges misdemeanors if committed by adults. East Palestine Police filed a complaint against a 13-year-old boy for striking his sister on Oct. 31. Liverpool Township Police filed a complaint against a 16-year-old boy who made threats against his mother on Nov. 11.

A Wellsville teen accused of striking a Columbiana County deputy sheriff with a car in July was placed on intensive supervised probation recently after a commitment to the Department of Youth Services was suspended.

The boy who was 16 years old at the time of the incident on July 5 had been charged with felonious assault, a first-degree felony if committed by an adult, and failure to comply with the order or signal of a police officer, a fourth-degree felony.

If it hadn't been suspended, the commitment to the DYS would have been for one year up to to age 21. A 90-day sentence at the Tobin Center was also suspended, with credit given for 14 days already spent at Tobin.

The incident occurred on Old Irondale Road where Deputy Steve Boyd and Det. Jeff Haugh were waiting for a domestic dispute suspect to drive by and saw a Geo Tracker-type vehicle speeding. When they attempted to stop the vehicle, the driver started coming toward Boyd's cruiser, which Boyd had exited. He was knocked into a ditch as the vehicle traveled past him.

A Leetonia student who had been charged for having a knife in her school locker on April 2 also received a suspended commitment to DYS which would have been six months up to to age 21 for illegal conveyance or possession of a deadly weapon or dangerous ordnance or of an object indistinguishable from a firearm in a school safety zone. The charge would be a fifth-degree felony if committed by an adult.

For purposes of probation, the case has been transferred to another county where she's now residing.

The knife was described in the complaint as 10 1/2 inches long with seven spikes along the bottom of the handle and was found in her bookbag in her locker. A police spokesman said she told them she was carrying the knife for protection due to a previous incident.
