COLUMBIANA COMMON PLEAS FOR 11-18
A Lisbon man charged with three counts each of rape and sexual battery will remain in jail under a $250,000 cash or surety bond and was ordered to provide a DNA sample to investigators.
Earl D. Hicks, 39, of 10100 Wayne Bridge Road, appeared Monday for a motions hearing in Columbiana County Common Pleas Court where his attorney asked the court to reduce his bond. Judge C. Ashley Pike denied the motion, but granted a motion by the prosecution to compel the defendant to provide a saliva sample for DNA.
County assistant Prosecutor Tim McNicol said no action was necessary on his motion for a handwriting sample from the defendant since the defendant agreed that he wrote a note that's in evidence.
Pike scheduled a trial date of Jan. 19 for the case, with a status hearing set for 11:30 a.m. Jan. 11.
The charges involved alleged sexual assaults against a teen-age girl over a three-year period starting in 2006
If convicted, Hicks could face a maximum 45 years in prison, with 10 years for each rape offense and five years for each sexual battery count, if the terms are ordered served consecutively.
