Common Pleas for 11-14

Vincent DiMaggio Jr., 40, of 1701 Main St., Wellsville, pleaded guilty to theft, possession of criminal tools and breaking and entering, all fifth-degree felonies, and receiving stolen property, a misdemeanor, with sentencing Jan. 22. Documents said DiMaggio and a co-defendant used acetylene torches to cut catalytic converters from four vehicles at Elkton Auto Corral on July 24, 2008. On July 30, 2008, he trespassed on the Columbiana Dodge property to steal catalytic converters and was caught with equipment to do the crime, such as acetyline torches, gloves, a scanner and flashlight. He also had a stolen CD player in his possession.

A Salineville man was allowed to withdraw his guilty plea to burglary and receiving stolen property charges.

Timothy Lewis, 54, of Lewis Road, Salineville, was charged in Columbiana County Common Pleas Court with burglarizing the home of Brian Wood, East Main Street, Salineville, in August 2008 and stealing miscellaneous items. He was also reportedly found in April 2008 in possession of two chain saws stolen from Edward Richards, Steubenville Pike, Lisbon.

As part of a plea deal reached in June with the county prosecutor's office, Lewis pleaded guilty as charged to receiving stolen property and to burglary, which was reduced from a second-degree felony to a third-degree felony.

Prior to sentencing, Lewis filed a motion asking to withdraw his guilty plea, claiming he is innocent of the charges and was confused at the time. Judge C. Ashley Pike said the record shows Lewis had a clear understanding of what he was doing by entering into the plea deal.

But Pike decided to allow Lewis to withdraw his guilty plea since it wasn't an old case and the prosecutor's office case would be unaffected by him doing so.

A status hearing in the case is scheduled for Dec. 7.
