Common Pleas for 11-8

POSTED: November 8, 2009

A Youngstown man who tried to steal a computer and computer stand from the Salem Wal-Mart by showing someone else's receipt to the door greeter pleaded guilty Monday to theft.

Ryan Ludington, 37, entered the guilty plea to the fifth-degree felony in Columbiana County Common Pleas Court. Judge C. Ashley Pike scheduled sentencing for Jan. 15. The charge carries a possible penalty of up to 12 months in prison.

Court documents said the incident occurred Dec. 4, 2008 at the Salem Wal-Mart when Ludington's co-defendant purchased a computer and computer stand, left the store and handed the receipt to Ludington. Ludington put a similar computer and computer stand in his cart and left the store without paying, using his co-defendant's receipt to show the store greeter on his way out. The computer and computer stand were valued at $582.

Also in Common Pleas Court:

Kenneth Phillips, 21, of 524 Columbia St., Salem, pleaded guilty to three counts of theft, all felonies, with sentencing Jan. 4. Documents said Phillips stole two shotguns and a crossbow from a vehicle on West Ninth Street in Salem on Dec. 17, 2008.

An East Palestine man who had sexual contact with a 12-year-old girl was sentenced to an indefinite term at the Eastern Ohio Correction Center, a probationary facility which serves as an alternative to prison.

Mark Buchner, 49, of 5127 state Route 14, appeared for sentencing Monday in Columbiana County Common Pleas Court for a third-degree felony charge of gross sexual imposition. He was placed on probation under community control sanctions for four years, with credit for two days served in the county jail.

Judge C. Ashley Pike also deemed him a Tier II sexual offender, meaning he'll have to register his address with the Sheriff's Office every 180 days for 25 years.

Court documents said the contact with the girl occurred during the summer of 1998 in a vehicle in East Palestine.

A Wellsville mother accused of abusing her children had her recognizance bond reinstated to keep her out of jail while her case remains pending, but under the condition that she stay at the residence where she's been living.

Michelle D. Darrah, 25, whose last known address was Clark Avenue, appeared in Columbiana County Common Pleas Court for a pretrial hearing Friday, a week after she failed to show up for another scheduled court hearing in her case. Her trial which had been scheduled to start this past week was cancelled and a warrant was issued for her arrest.

Judge C. Ashley Pike agreed to reinstate the bond for her release. A new trial date was set for Feb. 23, with a status hearing set for 11:30 a.m. Feb. 19.

Darrah was charged earlier this year with four counts of endangering children related to allegations that she recklessly abused her children and created a risk to their health and safety last fall.

The indictment alleged the abuse of her 4-year-old son occurred in September 2008 and the abuse of her 3-year-old daughter occurred in November 2008.

Ashley Miller, 22, of 1134 Jones Drive, Salem, was sentenced to 12 months in prison after pleading guilty to receiving stolen property, identity fraud and nine counts of forgery, all fifth-degree felonies. The sentence was to be served at the same time as a sentence in Stark County. Court documents said Miller used the personal identifying information of Brittany Rhodes and forged several stolen checks belonging to Rhodes on Oct. 30 and 31 in 2008.
