Common Pleas for 9-26

POSTED: September 26, 2009

The second man involved in the disappearance of "The Readers" bronze sculpture from outside the Columbiana Public Library last year pleaded guilty to receiving stolen property.

Matthew Stouffer, 23, of 33 N. Cross St., Columbiana, entered the guilty plea this week to the fourth-degree felony charge in Columbiana County Common Pleas Court. Judge C. Ashley Pike set sentencing for Nov. 20.

Stouffer and another man, Michael Nagel Jr., 24, of 215 Brenda Lane, Columbiana, were each charged with receiving stolen property after an investigation into the theft of the sculpture on Jan. 27, 2008 ended with the sculpture's recovery from a Youngstown scrap yard on Jan. 28, 2008.

The sculpture depicting two children reading on a bench was sold to the scrap yard for $331. Court documents said it was valued at $14,485. Stouffer was the one who sold the sculpture, while Nagel hauled the stolen sculpture in the back of his mother's SUV, according to court documents. Nagel was sentenced to prison for 10 months after entering a guilty plea last year.

The charge against Stouffer carries a maximum penalty of 18 months in prison.

The statue has since been returned to its spot outside the library.

Also in Common Pleas Court:

Jason Barnes, 36, of 945 Center St., Wellsville, was placed on probation for five years for two counts of non-support of dependents, a fifth-degree felony. Documents said Barnes failed to pay child support for two children from January 2006 through June 2008.

An East Liverpool man caught with cocaine hidden in his shoe at the Columbiana County jail was sentenced to six months at the Eastern Ohio Correctional Center, a probationary facility which serves as an alternative to prison.

John Felton III, 34, of 136 Ravine St., appeared for sentencing Thursday in Columbiana County Common Pleas Court for illegal conveyance of a prohibited item onto the grounds of a detention center, a third-degree felony, and possession of drugs, a fifth-degree felony.

Judge David Tobin placed him on probation under community control for four years, but ordered the first six months served at the EOCC. His driver's license was suspended for six months.

Court documents said Felton was being booked into the jail on other charges on Dec. 1, 2006 when a correction officer found the cocaine hidden inside his shoe.

Jaclyn Stafford, 26, whose last known address was Pinewood Drive, New Waterford, was sentenced to five years of intervention, or treatment, after pleading guilty to burglary, a fourth-degree felony amended from a third-degree felony. Her motion for intervention in lieu of conviction was granted. Documents said Stafford trespassed in the apartment of Greg and Jeneen Hostetter on Pinewood Drive, New Waterford on Jan. 8 and stole some baby clothes, a bassinette and a toilet seat.

Richard Stoddard II, 40, of Martins Ferry, was sentenced to prison for 240 days for possession of cocaine, a fifth-degree felony, after his intervention plan was terminated for violations. He received credit for 174 days already served in the county jail and his license was suspended for six months. Documents said Stoddard possessed cocaine during a traffic stop on Dresden Avenue in East Liverpool on Oct. 8, 2006.
