Criminal charge case dropped for New Cumberland man

LISBON - A man who was denied a previous request to have a criminal charge against him dismissed had his case dropped after all.

Shawn Chambers, 33, of New Cumberland, W. Va., was scheduled to face trial today for felonious assault, a second-degree felony, for allegedly using his vehicle to harm Frankie Harris on Nov. 16, 2005 by dragging Harris down the road for several blocks in East Liverpool.

The Columbiana County Prosecutor's Office filed a motion in Common Pleas Court to have the indictment dismissed because the victim in the case, Frankie Harris, couldn't be located. Judge C. Ashley Pike granted the motion.

Chambers' attorney, Joseph Ludovici, tried to have the charge dismissed previously by arguing that too much time had passed from the time of the incident and Chambers' initial arrest when he was served with the indictment in November 2008.

He had already pleaded guilty in East Liverpool Municipal Court to leaving the scene of an accident and reckless disregard for safety and was placed on probation with some jail time when the incident occurred in 2005. The indictment was issued in February 2006, but he wasn't served with it until two and a half years later.

The prosecutor's office also requested and was granted the dismissal of two other indictments.

Timothy Patrick, 24, whose last known address was Wellsville, had an indictment for domestic violence, a fourth-degree felony, dismissed after the prosecutor noted the victim was no longer cooperating in the prosecution of the case. The motion said she believed the case was going to be dropped and that the defendant, Patrick, just scared her. Documents alleged he attempted to harm a woman he knows on Feb. 18, with a previous conviction for domestic violence against him in East Liverpool Municipal Court.

An indictment for complicity to burglary, a third-degree felony, against Amanda Martin, 27, of 1019 Hazel St., East Liverpool, was dismissed after the prosecution cited new information received regarding her involvement in the burglary. The indictment had alleged that she helped two other people in the burglary at a Wellsville residence on Aug. 25.
