COMMON PLEAS FOR 5-28

POSTED: May 28, 2009

A West Virginia man imprisoned for his role in a Wellsville home invasion was granted early release and placed on probation for four years.

David Wales, 20, of Chester, was sentenced to prison for 24 months on May 22, 2008 for burglary, a third-degree felony. He received credit for 91 days served in the county jail. This was his second request for judicial release, with the first motion denied by Columbiana County Common Pleas Court Judge David Tobin earlier this year.

Wales was originally indicted for complicity to aggravated robbery for taking part in a robbery at a residence on Givens Road in Wellsville on Nov. 26, 2007.

Court documents said he and two co-defendants entered the residence wearing ski masks, encountered a 10-year-old girl and stole jewelry and guns at gunpoint. The girl wasn't injured.

Also in Common Pleas Court:

Craig Cross, 25, whose last known address was Salem, was placed on probation for four years for burglary, a fourth-degree felony, but was ordered to spend the first six months at the Eastern Ohio Correction Center. Documents said Cross trespassed in the residence of Jennings Douglas on Mullins Street in Salem on July 22, 2007.

David Kubik, 33, whose last known address was East Liverpool, was placed on probation for four years for failure to notify sheriff of change of address, a fourth-degree felony. Documents said Kubik failed to report that he moved last year, which he was required to do as a registered sex offender.

Mark Maddox, 50, whose last known address was Ravenna, was placed on probation for four years for nonsupport of dependents, a fifth-degree felony. Documents said he failed to pay child support from December 2001 to November 2007, with an accumulated arrearage of $30,877.
