Bond remains for murder suspect

By MARY ANN GREIER (mgreier@reviewonline.com)
POSTED: May 15, 2008

LISBON — Bond remained set at $2 million for Wellsville murder suspect Eric Dillard after a judge denied his motion for bond modification.

Columbiana County Common Pleas Court Judge C. Ashley Pike issued the decision Wednesday morning, two days after Dillard’s attorney, James Hartford, asked him to release his client on his own recognizance.

In his motion, Hartford claimed the death of 35-year-old East Liverpool resident Jamie Farley was a case of justifiable homicide.

The 30-year-old Dillard was arrested and charged with murder through county Municipal Court for the April 22 shooting outside his residence on Commerce Street where Farley was found lying beside a parked car near the intersection of 10th and Commerce streets suffering from apparent gunshot wounds.

Dillard’s case was bound over recently for consideration by the county grand jury and remains pending. Pike’s judgment entry was short, with no explanation offered for the denial.

Hartford wrote in his motion that “...the facts and circumstances of this case suggest that the strength of the evidence in this case will establish that the shooting herein was a justifiable homicide and that the alleged victim of the offense was a convicted drug trafficker...”

He claimed the victim “...was trespassing on the property of the defendant and had been ordered off the property by the defendant earlier in the day after engaging in violent and turbulent behavior and threatening to kill the defendant and his family.”

County Prosecutor Robert Herron said Monday that he pointed out the defendant’s own record, with a conviction for preparation of drugs for sale, a fourth-degree felony. Court documents said Dillard transported 464.69 grams of vegetable matter, identified as marijuana, in 10 separate bags found in the back of his car on April 18, 1999 in Yellow Creek Township. At the time, Herron said Dillard fled from police in his car and then fled on foot after his vehicle was boxed in by police cruisers.

The victim’s past record included a felony charge of trafficking in drugs in May 1999 for the sale of cocaine, along with several misdemeanor charges in Columbiana County Municipal Court and East Liverpool Muncipal Court, including one count of aggravated menacing in 2007.

Dillard remains in the Columbiana County jail.

I knew both of the men very well. Its a shame that this has happened to BOTH of the Families. I was shocked to find out it was Eric doing the shooting and not Jamie. I just didnt think eric had it in him to shoot and kill anyone, so I knew immediately that he had to of felt very threatened for the safety of him and his family. I think we all can agree even the people on Jamie's side that if your family was threatened we all would react in the same manner as Eric did "BY ANY MEANS NECESSARY". JAMIE would of never tolerated anyone threatening the life of his family or kids!!!! I am not standing up for ERIC, I am just saying we all should take a step back and say to our selfs WHAT WOULD I DO?

This story is dividing our little town. There are families and friends intertwind, put on different sides of the fences and that usually is never good. Hopefully it wont lead to any more violence.

If someone was at my home and threatened my family, and then had the nerve to come back, I cannot say that I would have not done the same. Let someone threaten your family and see how you react.

I had the unfortunate opportunity of attending school with Mr Dillard. I am not surprised where he is and where he is headed. It is a shame that this is what Wellsville is becoming known for. Does he know he won't get to share a cell with his sister

I do agree with meme419 Mr. Farley has 5 kids 4 of the 5 attend local schools and the media is doing nothing to protect those kids who are old enough to read what they are writing or saying on the news. How can the kids hold their heads high and remember their dad for what he was to them a loving father. It was not the kids fault but they are the only ones left HERE to deal with all the slander on their fathers behalf. The media should be sensitive about ALL the information that is released. NOT JUST WORRIED ABOUT PAPER SALES AND TELEVISION VIEWERS.

All Murder "Suspects" should remain in Jail. Unlike the "Other" case where the "suspect" is out on bond, given house arrest, and work release. but the press has chosen to ignore that case . I wonder why?

as the mother of jamie farley's 3 daughter's i do not appreciate attorney hartford slandering my chidern's father's name just because he had a past history of charges along with dillard does not mean that it was right for dillard to take his life, i don't appreciate hartford talking negative about farley due to his children are of age and they do have to attend school and yes kids do talk and the negative accusations are not helping my kids cope with their father's death Jamie may not be here to defend hisself but as the mother of his 3 daughter's i sure will i don't care what he did in the past all that matters is that he was an excellent father to all of his kids he loved them dearly and would do anything for them and whoever else was in need. dillard had no reason to take his life and i hope he pays for the pain and grief he has brought on this family and all of jamie's friends and if dillard ever happens to be released he will have to answer to my children
