Columbiana County Common Pleas

William E. Swain, 58, Lincoln Avenue, East Liverpool, pleaded guilty in Columbiana County Common Pleas Court to gross sexual imposition, a fourth-degree felony. He faces up to 18 months in prison and a $5,000 fine. Sentencing is set for Aug. 27. On March 30, 2016, Swain used his feet to rub the genitals of someone who was either unable to resist or consent due to impaired mental or physical condition or advanced age.

David L. Coulter, 36, Steubenville Pike, Lisbon, pleaded guilty to two counts of possession of drugs for having cocaine and 3-methylfentanyl on April 12, 2017. He faces up to two years in prison and a $5,000 fine. Sentencing is set for Aug. 27.

Francis D. Caine, 35, Valley Road, Salem, was placed on three years community control for possession of drugs. The sentence will included up to six months at the Eastern Ohio Correctional Center in Wintersville. Caine had less than the bulk amount of methamphetamine on March 17, 2017.

William A. Tondo, 25, last known address, Garfield Avenue, East Palestine, was placed on four years community control for two counts of burglary, each a third-degree felony. Tondo will also serve up to six months at the Eastern Ohio Correctional Center in Wintersville. On April 4, 2017, Tondo entered both his mother and sister’s East Palestine homes on Garfield Avenue and Alice Street, taking DVDs and a TV.

Joshua D. Smith, 41, Wintersville, pleaded guilty to receiving stolen property and asked for immediate sentencing. Smith was placed on community control under the same conditions he is currently on community control from a Jefferson County case. He will be serving up to six months at the Eastern Ohio Correctional Center for both cases. On Nov. 9, 2017, Smith had a 2003 Ford Taurus belonging to Penney Van Kirk.
