Civil lawsuit filed against driver in 2016 car accident

LISBON — The driver of a vehicle convicted for a May 27, 2016 vehicle crash which killed one of his passengers and seriously injured the other is now facing a civil lawsuit.

Tyler Barnes, Creek Road, New Waterford, filed the civil lawsuit this week against Jacob Chamberlain, who is now incarcerated in the Loraine Correctional Institution.

Chamberlain, formerly of East Palestine, was the intoxicated driver of a 2004 grey Chevrolet Impala which was headed northbound on Creek Road when he went off the left side of the road, striking a ditch and a tree before overturning the vehicle.

The crash killed Timothy Walton and left Barnes with broken bones, bruises and contusions. Chamberlain fled the scene and did not seek medical care for Barnes or Walton, whom he had left behind in the vehicle.

According to the lawsuit, Barnes to date has incurred medical expenses in excess of $380,480 and expects to continue to have additional medical care required, as well as permanent scars, pain and disabilities from the crash.

In February, Chamberlain, 19, was sentenced by Columbiana County Judge Scott Washam to six years in prison and had his license suspended for life for the crash.

At the hearing, Assistant County Prosecutor Ryan Weikart had noted experts from the highway patrol had estimated the vehicle had been going between 83 and 96 mph when Chamberlain failed to negotiate a right turn in the road after running a stop sign.

At a hearing on Nov. 15, 2017, Chamberlain pleaded guilty to all the charges against him — two counts of aggravated vehicular homicide, two counts of aggravated vehicular assault and three counts of OVI.

The civil lawsuit seeks in excess of $25,000.
