EP man receives jail time for theft
LISBON – A man accused of stealing from someone he was working for in 2005 was sentenced Monday to 90 days in jail by Columbiana County Common Pleas Court Judge C. Ashley Pike.
Assistant County Prosecutor Tammie Riley Jones said Dale C. Milnes, 51, Wheathill Road, East Palestine, was working in March 2005 for Michaela Nicotera and used an AT&T Universal Platinum Mastercard belonging to Nicotera to make several purchases for home improvement items. Without Nicotera’s permission, Milnes reportedly shopped at Kmart, Walmart, Lowe’s, Toys R Us, Splash and Shine Auto and Target.
Speaking before sentencing, Milnes said he barely remembers the crimes of theft and in his condition he said he does not plan to commit any additional crimes. He added every time he is incarcerated it is difficult for him. Still, he offered to make restitution.
His defense attorney, Jennifer Gorby, pointed out Milnes has cirrhosis of the liver and hepatitis, and needed a week to get his medications together before he goes to the county jail. He was credited with 38 days served, leaving him with 52 to serve.
While Pike said the length of time since the crime occurred and Milnes previous criminal records were of concern to him, he also said he was concerned about Milnes health. He ordered Milnes to stay out of trouble while on probation following his jail sentence and contact Nicotera about making restitution within 15 days of his release of prison.
“I hope you prove me wrong,” Pike said. “I don’t have a great deal of confidence in you so I hope you prove me wrong.”
