Common Pleas Reports for 4-12

Darin F. Rogers, 30, Carter Road, New Waterford, was found incompetent to stand trial, and the indictment against him was dismissed this week in Columbiana County Common Pleas Court.

Rogers is one of three members of a New Waterford area family who were charged with cultivating marijuana along with a forfeiture specification.

Russell F. Rogers Jr., 64; Roberta L. Rogers, 66; and Darin F. Rogers, 30, all of Carter Road, New Waterford, are all accused of having between 5,000 and 20,000 grams (11 to 44 pounds) of marijuana cultivating on Aug. 27, 2012. The elder Rogers are alleged to be the owners of three tracts of property in Unity and Middleton townships, which were used in the alleged offense. Additionally, all three are accused of owning a Suzuki Quad Sport four-wheeler, a Honda TRX 450R, a Honda Rincon four-wheeler, a Suzuki JSAAM and a Huskey Trailer, all of which were believed to have been used in the commission of the offense of cultivating marijuana.

In a report to the court, the examiner from the Forensic Psychiatric Center of Northeast Ohio Inc. wrote there is not a substantial probability Darin Rogers will be competent to stand trial within one year either.

Robert Chan, 57, Morton Street, East Liverpool, pleaded guilty in county Common Pleas Court to four counts of possession of drugs. Chan reportedly had cocaine and morphine on Aug. 15, 2013 and heroin and cocaine on Feb. 21. He faces up to four years in prison, a $10,000 fine and a 20-year license suspension. Sentencing is set for June 9.
