CEC Files appeal for injuried inmate
LISBON — The Community Education Centers Inc., has filed an appeal of a worker’s compensation claim filed by a county jail employee reportedly injured by an inmate.
According to court documents from a case filed in Common Pleas Court, Joshua Mellinger was working at the county jail on Feb. 3 of this year when he reportedly was injured.
An assault charge was later filed against Jacob S. Lowther, 23, West Summit Street, East Liverpool, who was accused of pulling Mellinger into his cell and punching him. Lowther pleaded guilty in June to the assault and was sentenced to six months in prison.
Mellinger had filed a worker’s compensation claim for alleged injuries of fractured nasal bones, a cervical strain, nasal abrasion and facial contusion. The initial claim was allowed, but was then appealed by the CEC. First the CEC appealed the case to the administrator and it was referred to the Industrial Commission’s district hearing officer and staff hearing officer for reviews.
The Industrial Commission of Ohio has granted Mellinger’s claim, but the CEC then appealed the decision to Mahoning County Common Pleas Court.
That court transferred the case to Columbiana County, following motions involving proper venue.
